Your use of the website is subject to these terms, and by using the website you demonstrate your agreement to such terms. If you do not agree to these terms, please do not use the website. Changes to terms and records of agreements
EDS reserve the right to change these terms and conditions at any time by posting changes on the website. It is your responsibility to review the website terms and conditions regularly to ensure that you are aware of the latest terms and conditions. Your use of this website after a change has been posted will be deemed to signify your acceptance of the modified terms and conditions.
We recommend that you print off and retain for your records a copy of these terms and conditions from time to time and a copy of any terms and conditions relating to any product or service which you apply for on-line, together with any related application form completed and submitted.


EDS Pupil Terms and Conditions
We reserve the right to change these Terms from time to time. Any changes to these terms will take effect immediately and shall be notified to you.

Your Instructor and EDS
In these terms and conditions (the “Conditions”) “We”, “Us”or “Our” means. Your instructor is a self employed franchisee (“Your Instructor”) of 3 Tier Systems UK Ltd trading as “eDrivingSchool” (“EDS”, “We”, “Us”, “our”).

EDS acts as agent for Your Instructor in receiving any payments for driving tuition other than payments made directly by You to Your Instructor. Where EDS makes bookings with, or supplies any information or documentation to You, or processes any payments for Your lessons, they act as the agent of Your Instructor.

The contract for driving tuition is solely between you (“You”) and Your Instructor.

Tuition
Tuition is only available to persons who meet the following criteria:
· Aged 17 or over, or aged 16 or over and in receipt of or have applied for the enhanced rate
of the mobility component of Personal Independence Payment (PIP), or in receipt of the
higher rate of Disability Living Allowance (mobility component); and
·hold a valid UK provisional driving licence; and
·legally entitled to drive in the UK.

Lessons
You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons. You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid UK provisional driving licence.

Your instructor cannot guarantee that they will be available each time you choose to request a driving lesson. It is your responsibility to agree and confirm the timing of lessons with your instructor.

Cancellation of Lessons
If You or Your Instructor wish to cancel a lesson a minimum of 48 hours’ prior notice should be given. If Your Instructor cancels a lesson, Your Instructor shall rearrange the lesson. Cancellations made by You must be made through the Customer Service Centre or directly between You and Your Instructor. Please note that the CSC is not open on Bank Holidays, Saturday or Sunday. Cancellation requests cannot be actioned outside of office hours. If you do not give at least 48 hours’ notice of cancellation You will be charged for the lesson(s) concerned in full.

In the event of you having booked your driving test, the Driver and Vehicle Standards Agency (DVSA) requires you to give three clear working days to cancel your test. This may mean that you may lose your DVSA test fee if your instructor says you’re not ready for your test within
this three day notice period.

Any disputed transaction will be promptly and fully investigated by EDS. The result of the investigation will be communicated to both parties. No payment will be made to either party until the investigation has been completed to the satisfaction of EDS.

Payments
Unless Your instructor advises otherwise you must pay for any tuition before the start of the lesson. Please note that the CSC is not open on Bank Holidays, Saturdays or Sundays. Payments cannot be taken outside office hours. You can use one of the following methods of payment:

1. Payment by credit or debit card by telephoning the Customer Service Centre on 0845 2267649
2. Voucher and gift cards have no cash value and have to be redeemed against tuition.
Voucher and gift cards are not transferable once they have been redeemed.
3. Payment by cash or cheque direct to Your Instructor (any cheque must be made payable to
Your Instructor)
EDS has no responsibility or liability to You for payments made by any other means. If You pay Your Instructor directly by any method, You should obtain a receipt. EDS accepts no responsibility for any payments made directly to instructors

Funds paid to EDS for any prepaid driving lessons to be provided by Your instructor must be applied to driving lessons by You within six months of the date of your original payment to EDS. You acknowledge that after the expiry of this six month period, You will not be entitled to a refund of any funds not applied to driving lessons or to utilise these funds for booking further driving lessons. If, at any point during this six month period you determine that you do not wish to take any more of your prepaid driving lessons, you are entitled to a refund of the balance of your funds based on the hourly rate. To request a refund, call EDS.

Any funds paid directly to your instructor are not protected by EDS.

Refund
For security reasons, any refund made by EDS will be made back to the card from which the original payment was taken. If for any reason those card details have become invalid before any refund can be made, EDS reserves the right to verify the identity of the person requesting the refund and seek verification of the validity of any alternative card or bank account details provided by You.


Price Changes
The cost of prepaid tuition is based on the lesson price in force at the time of booking and with the exception of the circumstances set out below, will be honoured for 6 months
thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 6 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by You. Circumstances where, if You have prepaid, You will be either be required to pay an additional amount beyond the cost of Your pre-paid lessons or receive a refund of some of Your prepayments (as applicable):

Location Change
1. Where You have moved postcode area and requested reallocation to another Instructor
because Your current Instructor does not operate in the new postcode area, You will be
required to cover any difference in the hourly rate between those Instructors where Your
new Instructor charges a higher hourly rate or, where Your Instructor charges a lower rate,
you will be refunded the difference.

2. Where you have requested to switch Instructors within the same postcode area and Your
new Instructor charges a higher hourly rate than Your previous Instructor You will be
required to pay the difference in the hourly rate or, where Your Instructor charges a lower
rate, receive a refund of the difference.

3. Where You have moved postcode area and requested reallocation to another Instructor
and we do not have an instructor available you will be able to request a refund for lessons not taken. Refunds made from a block booking will be based on the hourly rate charge for those hours taken.

VOUCHERS – Terms and Conditions
 General

  • Driving lessons are only available to those who hold a driving licence valid in the UK.
  • Your instructor reserves the right to refuse to provide you with driving lessons or to cancel any driving lessons you have booked, if you fail to provide proof of an appropriate licence prior to your first driving lesson.
  • EDS does not guarantee that a specific instructor, vehicle, or driving lesson time will be available.
  • Always keep the voucher in a safe place as it cannot be re-issued if lost or damaged.
  • The voucher is valid until the date shown and must be redeemed by that date.
  • The voucher has no cash value.
  • The voucher is non-refundable.

Gift Vouchers

  • With gift voucher purchases the number of driving lessons stated on the voucher are guaranteed only in the postcode stated on the voucher. Driving lessons taken in a different area may result in less than the stated number of driving lessons being available.
  • Gift vouchers are subject to availability and instructor coverage in your area.
  • Gift vouchers are for the individual named on the voucher and are not transferable.

Introductory Offers
Introductory offers are only available to new customers with EDS. Only one introductory offer is allowed per customer.
Introductory offers often start with beginner’s driving lessons i.e. You will learn about the controls of the car before progressing to moving off and stopping the vehicle. In other introductory offers, the lessons may be structured to meet your needs relevant to your experience. EDS reserves the right to remove or amend any introductory offers at any time.

Liability
Your instructor and/or EDS are not liable to you for any loss or damage caused where, and to the extent that:

  • There is no breach of a legal duty owed to you by the relevant person or body;
  • Such loss or damage is not a reasonably foreseeable result of such a breach of a legal duty;
  • Any such loss or damage, or increase in the same, results from any breach or omission by you; or
  • Any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.

Your instructor and/or EDS shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, loss of opportunity or business or business interruption.
Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.

Use of personal information
Information about you that you provide to EDS and/or your instructor may be used to:

  • Identify you;
  • Help administer, and contact you about improved administration of, any accounts, services and products provided to you;
  • Trace debtors, recover debt, prevent and detect fraud, and to manage your accounts or insurance policies; and check your identity to prevent money laundering unless you give us other satisfactory proof of identity;
  • Carry out marketing analysis and customer profiling (including with transactional information) and create statistical and testing information;
  • Help identify accounts, services and/or products which we feel may be of interest to you. We may do this by automatic means using a scoring system, which uses the information you have provided, any information we hold about you, and information from third party agencies (including credit reference agencies);
  • Contact you in any way (including mail, email, phone, visit, text or multimedia messages) about products and services offered by us and selected partners.
  • Provide information that has been legitimately asked for by legal or regulatory bodies or where we are required to provide it as part of legal proceedings or prospective legal proceedings.
  • We may monitor and record communications with you (including phone conversations and emails) for quality assurance, legal, compliance and training purposes.
  • We may check your details with fraud prevention agencies. If you provide false or inaccurate information and we suspect fraud, we will record this and may provide this information to fraud prevention agencies and other relevant authorities including the police.
  • Allow our selected partners to contact you about products and services offered by them. They will only contact you in this way if you have previously indicated your consent.
